Terms & Conditions
These Terms and Conditions apply to the Glib: AI Learn & Speak English app for mobile devices, together with any related services operated by IOBits Technologies (collectively, the "Application"). IOBits Technologies is hereby referred to as the "Service Provider".
By downloading, installing, or using the Application, you agree to these Terms and Conditions. Please read them carefully before using the Application.
License to Use the Application
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on your personal mobile device for lawful purposes.
You may not:
Copy, reproduce, or distribute the Application or its content except as permitted by applicable law
Modify, adapt, or create derivative works from the Application
Reverse engineer, decompile, disassemble, or attempt to obtain the source code of the Application, except where such activity is expressly permitted by applicable law
Remove, alter, or obscure copyright, trademark, or other proprietary notices
Use the Application for unlawful, fraudulent, or abusive purposes
Interfere with or attempt to disrupt the operation or security of the Application
Nothing in these Terms limits any rights that cannot legally be restricted under applicable law.
Intellectual Property
The Service Provider and its licensors retain all rights, title, and interest in the Application, including its software, design, graphics, content, trademarks, service marks, logos, and branding.
These Terms do not grant you any ownership rights in the Application or the Service Provider's intellectual property.
You may not use the Service Provider's trademarks, logos, branding, or other proprietary materials without prior written permission.
Acceptable Use
You agree to use the Application only for lawful purposes and in accordance with these Terms.
You must not use the Application to:
Violate applicable laws or regulations
Infringe the intellectual property or privacy rights of others
Attempt to gain unauthorized access to the Application or its systems
Introduce malware, viruses, or other harmful code
Interfere with the Application's operation or security
Abuse, exploit, or misuse any feature of the Application
Use automated methods to access or interact with the Application where such use is not authorized
The Service Provider may take reasonable action where misuse or abuse of the Application is detected.
AI Features and Gemini API
The Application uses the Google Gemini API to provide certain AI-powered language-learning features.
When you use features that rely on the Gemini API, information submitted through those features may be processed by Google to generate AI responses and provide the requested functionality.
The use of the Gemini API is subject to Google's applicable terms and privacy practices. Users should avoid submitting sensitive personal information, passwords, financial information, government identification numbers, or other confidential information through AI-powered features unless specifically required by the Application.
Application Features and Availability
The Service Provider may add, modify, improve, suspend, or discontinue features of the Application from time to time.
The Service Provider does not guarantee that every feature will always be available or that the Application will always be compatible with every device or operating system version.
Some features may require an internet connection. You are responsible for having a suitable internet connection and for any charges imposed by your mobile network provider.
If you use mobile data, roaming, or other paid network services, your network provider's terms and charges may apply.
Advertisements and Third-Party Services
The Application may display advertisements provided by third-party advertising services.
The Application may use third-party services, including:
These third-party services may have their own terms and privacy policies. Your use of the Application may therefore also be subject to the terms and policies of applicable third-party service providers.
The Service Provider does not control the policies or practices of third-party services.
Payments and Charges
The Application may contain free and/or paid features, subscriptions, or other in-app purchases.
Where charges apply, the applicable price and payment terms will be presented before you complete a purchase.
Purchases made through Google Play are subject to Google Play's applicable payment and purchasing terms.
The Service Provider may change the availability, pricing, or features of paid services in the future. Any applicable charges will be presented to you before a new purchase or renewal where required by applicable law.
Account and Device Security
If the Application provides account-related features, you are responsible for keeping your account credentials secure and for activity carried out through your account.
You are also responsible for maintaining the security of your mobile device.
The Service Provider recommends that you do not jailbreak or root your device because doing so may reduce the security of the device and may cause the Application to malfunction.
Termination
The Service Provider may suspend or terminate your access to the Application if you materially violate these Terms, applicable law, or the rights of others.
Where appropriate and legally required, the Service Provider may provide notice and an opportunity to remedy a violation before termination.
The Service Provider may also suspend or terminate access immediately where necessary to address serious security risks, unlawful activity, fraud, abuse, or other circumstances that require immediate action.
Upon termination, your right to use the Application will end and you should stop using the Application and delete it from your device.
Disclaimer
The Application is provided on an "as available" basis to the extent permitted by applicable law.
The Service Provider does not guarantee that the Application will always be uninterrupted, error-free, secure, or compatible with every device or operating system.
AI-generated responses and other content provided through the Application may not always be accurate, complete, or suitable for every purpose. Users should use their own judgment when relying on AI-generated information.
The Service Provider is not responsible for interruptions caused by circumstances outside its reasonable control, including network failures, device problems, operating system changes, or third-party service interruptions.
Nothing in these Terms excludes or limits rights or protections that cannot legally be excluded or limited under applicable law.
Limitation of Liability
To the fullest extent permitted by applicable law, the Service Provider will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Application.
The Service Provider will not be liable for loss of data, business interruption, or loss of profits to the extent such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or other mandatory legal liability.
To the extent permitted by applicable law, the Service Provider's total liability arising from your use of the Application will be limited to the amount you paid for the Application or applicable paid services during the 12 months preceding the event giving rise to the claim, or the minimum amount required by applicable law, whichever is required by law.
Indemnification
To the fullest extent permitted by applicable law, you agree to be responsible for claims, damages, liabilities, and reasonable expenses arising directly from your material violation of these Terms or your unlawful misuse of the Application.
This section does not apply to the extent that applicable law prohibits such an obligation or where the claim results from the Service Provider's own unlawful conduct or negligence.
Updates and Changes to the Application
The Service Provider may release updates to improve, modify, or maintain the Application.
You may need to install updates to continue using certain features or to maintain compatibility with supported operating systems.
The Service Provider does not guarantee that the Application will always support every version of every operating system.
The Service Provider may discontinue the Application or particular features where permitted by applicable law.
If the Application is discontinued, your license to use the discontinued Application will end and you should stop using it and delete it from your device.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws applicable to the jurisdiction in which the Service Provider is established, except where mandatory consumer protection or other applicable laws provide otherwise.
Any dispute arising from or relating to these Terms will be handled by a court or other competent authority with jurisdiction under applicable law.
Nothing in this section limits any mandatory legal rights you may have.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable.
The remaining provisions will continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with the Privacy Policy, constitute the agreement between you and the Service Provider concerning your use of the Application.
Changes to These Terms and Conditions
The Service Provider may update these Terms and Conditions from time to time.
When changes are made, the updated version will be posted with a revised effective date. Where required by applicable law, the Service Provider will provide additional notice or obtain consent.
You are encouraged to review these Terms periodically.
